Couple squares off with EQC in High Court

A Christchurch couple will square off with the Earthquake Commission and insurer Southern Response in the High Court today.

Cameron and Suzanne Kelly claim the foundation in their TC3 home in Burwood was significantly damaged in the February earthquake, and they're entitled to a rebuild.

Their lawyer Grant Shand says both EQC and Southern Response accepted for over three years the damage was caused by the earthquakes, until early this month when they decided the damage was pre-existing.

"Suddenly a house in the centre of earthquake damaged houses in Burwood magically suffered no foundation damage when all of the houses around it have suffered significant foundation damage. It's a case that just doesn't make sense."

Mr Shand says one of the current theories EQC has is that over time, the wind has blown the house off its foundations.
