Playboy Files Lawsuit Against Fashion Nova for Trademark Infringement

·2-min read

Playboy Enterprises, Inc. has filed a lawsuit in the U.S. District Court for the Central District of California against Fashion Nova, Inc. for infringing Playboy’s world-famous Playboy BUNNY COSTUME design (the "BUNNY COSTUME®").

Playboy has been a leading global lifestyle and entertainment brand for over 65 years. Playboy takes its brand seriously and makes the defense and enforcement of its renowned trademarks, including PLAYBOY, the RABBIT HEAD DESIGN, and the BUNNY COSTUME®, a cornerstone of its efforts to ensure that when consumers see the Playboy marks, they can expect the associated goods or services to have the backing of Playboy. The BUNNY COSTUME® has been associated with Playboy for over 60 years, since it first debuted at the Playboy Club in Chicago, and the BUNNY COSTUME® has since become a staple of the Playboy brand. The BUNNY COSTUME® was the first service uniform registered with the United States Patent & Trademark Office, and a complete BUNNY COSTUME® can be found in the collection of the Smithsonian.

In keeping with its brand-protection efforts, Playboy was forced to take legal action against Fashion Nova today based on Fashion Nova’s unauthorized marketing and sale of multiple versions of Playboy’s iconic BUNNY COSTUME®, which Fashion Nova continued even after Playboy informed Fashion Nova of Playboy’s exclusive rights to the BUNNY COSTUME® and requested that Fashion Nova cease and desist its unauthorized use. Playboy considers the defense and enforcement of its celebrated trademarks of paramount importance in protecting its customers from those who wish to knowingly profit from deception and confusion.
